Terms of Service

These Terms of Service ("Terms") govern your use of ListingNest AI (the "Service"). By creating an account you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

1. The Service

ListingNest AI provides listing marketing generation, open-house lead capture, lead scoring, follow-up automation, and reputation tools for real estate professionals. AI-generated content is a draft that you must review; you are responsible for all content you publish or send.

2. Accounts & workspaces

  • You must provide accurate information and keep your credentials secure.
  • Workspace owners control member roles and are responsible for their team's use of the Service.
  • You must be authorized to practice real estate marketing in your jurisdiction where required.

3. Acceptable use

  • No sending SMS or marketing email without lawful consent from the recipient.
  • No discriminatory, misleading, or otherwise unlawful marketing, including violations of fair-housing laws.
  • No fake, incentivized, or fabricated reviews. The Service only assists in requesting honest reviews from real clients.
  • No attempts to access other tenants' data or to circumvent usage limits or security controls.

4. Consent & messaging compliance

You are the sender of messages dispatched through your workspace. You must ensure a valid consent basis for each recipient and honor opt-outs. The Service records consent and blocks messages without a consent record, but ultimate legal responsibility for compliance (e.g., TCPA, CAN-SPAM, GDPR) remains yours.

5. Subscriptions & billing

Paid plans are billed monthly through PayPal. Plans renew automatically until cancelled. When you cancel, access continues until the end of the current billing period. Usage limits (listings, seats, AI credits) are enforced per plan. Fees are non-refundable except where required by law.

6. Intellectual property

You retain all rights to the content you upload and the content generated for you, subject to the rights of third parties. We retain all rights to the Service and its software.

7. Disclaimers

The Service is provided "as is". AI outputs may contain errors and are not legal, financial, or professional advice. The Compliance Guard is an assistive screen, not a legal review. We disclaim all warranties to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms is limited to the amounts you paid to us in the twelve months preceding the claim.

9. Termination

You may cancel at any time. We may suspend or terminate accounts that violate these Terms, with notice where practicable.

10. Changes

We may update these Terms. Material changes will be announced by email or in-app at least 14 days before they take effect.
